Who Needs Food Manager Certification in Delaware?

The Delaware Food Code (16 DE Admin. Code 4458) requires a Certified Food Protection Manager (CFPM) at permitted food establishments. The Delaware Division of Public Health (DPH) Office of Food Protection has enforced the requirement since April 1, 2016.

  • At least one employee, the person in charge at the time of inspection, must be a CFPM.
  • The CFPM must pass a test that is part of an accredited program.
  • DPH’s FAQ says full compliance means having a CFPM on site at all times.

Risk-based variances

Exceptions and Variances

  • High-risk establishments are not eligible for a variance.
  • Very low-risk establishments, such as those serving the public 52 times a year or less, or serving no TCS foods, may qualify for a statewide variance. Low- and medium-risk establishments may apply for an individual variance.
  • Variance holders still need a CFPM on site, a CFPM on staff who trains the other persons in charge, or approved training for all persons in charge.
  • Very low-risk charitable and fraternal organizations are exempt by state law.

Delaware Food Manager Certification FAQs

Is food manager certification required in Delaware?

Yes. Section 2-102.12 of the Delaware Food Code requires at least one employee, the person in charge at the time of inspection, to be a Certified Food Protection Manager who passed a test that is part of an accredited program.

When did the requirement start?

Delaware DPH began requiring permitted food establishments to have a CFPM on April 1, 2016.

Does a certified manager need to be on site at all times?

The rule applies to the person in charge at the time of inspection. DPH’s FAQ says an establishment is in full compliance when it has a CFPM on site at all times, unless it has an approved variance.

Can my establishment get a variance?

It depends on your risk category. Very low-risk establishments may qualify for a statewide variance, and low- or medium-risk establishments may apply for an individual variance through the DPH Office of Food Protection. High-risk establishments are not eligible.

What does an establishment with a variance still need?

It must have a CFPM on site during all hours of operation, a CFPM on staff who trains the other persons in charge and is reachable by phone, or all persons in charge must complete approved food safety training.

Are charitable or fraternal organizations exempt?

Delaware Code Title 16, Chapter 34 exempts very low-risk charitable and fraternal organizations. Others may request an individual variance, and high-risk organizations are not eligible for an exemption or variance.

Is the Always Food Safe certification accepted in Delaware?

Yes. Delaware requires a test that is part of an accredited program. The Always Food Safe Food Protection Manager exam is accredited by the ANSI National Accreditation Board (ANAB) under Conference for Food Protection standards.

Can I take the Delaware food manager exam online?

Yes. The exam is taken online with a remote proctor from your home or office. No scheduling is required. You need a laptop, desktop or Chromebook with a webcam and microphone, a government-issued photo ID and a private room.

How long is the certificate valid?
