Who Needs Food Manager Certification in New Hampshire?
New Hampshire law requires licensed food service establishments to have a person in charge who is a Certified Food Protection Manager (CFPM), present during all hours of operation, with a few practical exceptions.
RSA 143-A:11-a & He-P 2303.02
State CFPM Requirement
- Each state-licensed food service establishment must have a person in charge present during all hours of operation who is a certified food protection manager.
- With a CFPM on staff, the CFPM does not have to be present when no food preparation is happening or prep is limited to reheating commercially prepared or ready-to-eat food.
- With 5 or fewer food employees on duty, one CFPM on staff who is available, though not necessarily present, is enough.
- New establishments have 45 days after the initial licensing inspection. If your CFPM leaves, you have 90 days to come into compliance.
- Keep each CFPM’s exam certificate available for inspectors.

Exemptions & local health departments
Exempt Operations and Cities
- Exempt categories include bed and breakfasts, continental-breakfast lodging, retail stores with no food prep, pushcarts and mobile units serving packaged or non-TCS food, bars without a food prep area, vending, wholesalers and farm stores.
- Some cities run their own health inspections. Manchester requires the person in charge during food preparation to be a CFPM and lists Always Food Safe Company, LLC among its approved programs.
- If you are in another self-inspecting city or town, confirm details with your local health department.

New Hampshire Food Manager Certification FAQs
Is food manager certification required in New Hampshire?
Yes, for most food service establishments. RSA 143-A:11-a requires each state-licensed food service establishment to have a person in charge, present during all hours of operation, who is a certified food protection manager.
Does the certified manager have to be on site at all times?
Not always. If you have a CFPM on staff, they do not need to be present when no food preparation is taking place or when preparation is limited to reheating commercially prepared or ready-to-eat food. With 5 or fewer food employees on duty, one CFPM on staff who is available is enough.
How long does a new establishment have to get certified?
Under He-P 2303.02, a food establishment in initial licensing must have a certified food protection manager within the first 45 days of the initial licensing inspection.
What if our certified manager leaves?
If your CFPM leaves and the establishment falls out of compliance, New Hampshire gives you 90 days to come into compliance.
Which New Hampshire establishments are exempt?
Exempt categories under He-P 2303.02 include bed and breakfasts, lodging serving continental breakfasts, retail stores with no food preparation areas, pushcarts and mobile units serving packaged or non-TCS foods, bars without a food preparation area, vending machines, wholesalers and farm stores.
